IT BEING PREVIOUSLY NOTED THAT :
Albatross Foundation invites you to use an innovative AI-based platform “Gaia Voice”, which aims to raise children’s awareness of sustainable development and the environment through interactive storytelling and empathetic AI coaching. The initiative aims to help young people understand and apply the principles of the United Nations’ 17 Sustainable Development Goals (SDGs) (the ” Platform “). The Platform is based on a conversational AI tool developed by third-party provider “personal.ai”, whose terms of use are available via the following link: https://www.personal.ai/terms-of-service .
The Platform takes the form of a web application accessible via www.albatross global.org; www.albatrosslegal.org; www.create2donate.org (hereinafter referred to together or separately as the ” Site “) or via the QR code supplied with products associated with Gaia Voice including, without limitation, books, games, puzzles, cards and other derivative products.
These general conditions of use (the ” General Conditions of Use “) govern the use of the Platform, and more specifically the Gaia Voice Coach, by the Beneficiaries (as described below).
IT IS HEREBY AGREED AS FOLLOWS :
I. DEFINITIONS
Terms used in these Terms of Use have the meanings given to them in this article:
| ALBATROSS: | refers to Albatross Foundation, a non-profit organization dedicated to promoting sustainable development through education and community initiatives (Siret n. 83753201900010). |
| Beneficiary : | means any User or Legal Guardian. |
| Gaia Voice Coach: | designates the conversational AI tool enabling Users to exchange with a “virtual coach”. |
| General Conditions of Use or GCU : | means the conditions and rules for use of the Platform and Site that must be respected by all Beneficiaries. |
| Contents : | refers to all content made available to Beneficiaries via the Site and/or Platform; |
| Intellectual Property Rights : | means all rights, registered or not, pertaining to copyrights, designs, trademarks, trade names, domain names, confidential information, know-how and other intellectual property rights within the meaning of Article 2 of the Convention of July 1967 establishing the World Intellectual Property Organization. |
| Part(s) : | means together or separately the Beneficiary and ALBATROSS. |
| Platform : | means the Platform, as described in the Preamble hereto, its functionalities and all its components. |
| Services : | refers to the services provided to Beneficiaries via the Platform. |
| Site : | means the website via which the Platform is made available to Beneficiaries, as referred to in the Preamble. |
| User : | means any person browsing the Platform and using the Services. |
| Minor user : | means any User under the age of fifteen (15). |
| Legal guardian : | means any natural person who is the legal guardian, in accordance with the law, of a minor User. |
II. PURPOSE AND ACCEPTANCE
The purpose of the GCU is to define the conditions under which the Platform is made available to Beneficiaries and the rules they undertake to respect when accessing it. They are also intended to provide information on the rights, obligations and responsibilities of each party with regard to the use of the Platform and the Gaia Voice Coach.
Use of the Platform and the Gaia Voice Coach by the User is subject to acceptance of the GCU by the User or, in the case of a User who is a Minor, by his/her Legal Guardian. The User agrees to read and abide by the GTUs when connecting to the Platform for the first time.
ALBATROSS reserves the right to modify the terms, conditions and mentions of the GCU at any time, by publishing them on the Site. The User undertakes to take cognizance of and abide by the modified GCU. Users under the age of 18 undertake to inform their Legal Guardian of any new version of the GCU.
The Beneficiary acknowledges and accepts that the Platform is developed on the basis of the AI tool “personal.ai” over which ALBATROSS has no means of control or guarantee. The use of the Platform and the Services by the User, as proposed by ALBATROSS, is also subject to the conditions specific to “personal.ai” from which they originate and which the User undertakes to take cognizance of and respect, which he expressly acknowledges.
III. DURATION
The GCU come into force upon acceptance by the Beneficiary and are applicable throughout their use of the Platform and Services.
Notwithstanding the foregoing, articles XI, XII and XIV of the GCU shall remain applicable for a period of ten (10) years after the end of use of the Platform and/or Services by the Beneficiary.
IV. DESCRIPTION OF FUNCTIONS
The Platform provides Users with conversational AI and AI analysis services, based on the work of authors and creators selected by ALBATROSS, through the Gaia Voice Coach.
The Gaia Voice Coach allows any User, in particular, to :
- Ask any question related to the work of the author or creator selected by ALBATROSS and whose persona is concerned;
- Take note of the answers provided by the Platform on the basis of this work;
- Converse with the Platform to fine-tune the answers provided and raise other questions related to the themes addressed in the aforementioned work;
- Learn about the principles of the 17 United Nations Sustainable Development Goals (SDGs).
- V. PLATFORM ACCESS AND REGISTRATION
- 5.1 Technical conditions of access to the Platform
The Services, and in particular the Gaia Voice Coach, are intended for Beneficiaries and a public of Underage Users, under the responsibility of their Legal Guardians, who must ensure that such use is appropriate to the profile and capacities, in particular the emotional capacities, of each Underage User. Users under the age of 15 may only access the Platform with the consent and supervision of their Legal Guardians, in accordance with the provisions of these GCU.
To access the Platform, the Beneficiary must have :
- A computer workstation (computer, telephone, tablet, etc.);
- A browser ;
- Broadband Internet access, fixed or mobile.
It is the Customer’s responsibility to check the compatibility of their IT equipment with the technological solutions deployed.
Furthermore, it is the responsibility of the Beneficiary to protect his/her computer (computer, mobile, tablet, etc.) against the intrusion of viruses, spyware, Trojan horses and other parasites of an intrusive or destructive nature.
5.2 Connection procedure
Connection to the Platform is :
- From the QR Code and/or URL available on products associated with Gaia Voice ;
- From a URL link on the “Site.
By accessing the Platform for the first time and continuing to use it, the User is deemed to accept the GCU and, in the case of a User who is a Minor, agrees not to use it unless accompanied by his/her Legal Guardian.
6. USER RESPONSIBILITY
6.1 Users’ compliance with the law
Users, under the responsibility, where applicable, of their Legal Guardians, undertake not to use the Platform for abusive purposes and not to help a third party to do so. In particular, but without limitation, Users agree not to undertake or attempt to undertake the following actions via the Platform and the Gaia Voice Coach:
- The possession and sharing of obscene, violent and/or paedophile images and/or works protected by intellectual property rights without having obtained prior authorization from the authors;
- The dissemination of messages inciting sectarianism or hatred towards a person or a group of people because of their religion, ethnic origin, sex, gender identity, sexual orientation, disability or any other incapacity;
- Disseminating content or information that infringes the law in any way whatsoever, in particular by storing, publishing or sharing fraudulent, defamatory or misleading content;
- Invasion of privacy or rights of others;
- Violating or otherwise circumventing any security or authentication measures and/or attempting to access areas of ALBATROSS that they are not authorized to access.
The User undertakes to communicate, via the Platform, only accurate, lawful and true information and data. The User undertakes to comply with legal provisions and, in particular, not to usurp the identity of others.
ALBATROSS is not responsible for content shared or stored via its Platform and is under no general obligation to monitor such information.
ALBATROSS invites any Beneficiary who becomes aware of fraudulent use of the Platform to inform it by any means at its disposal, including by e-mail: info@albatrissglobal.org or by post: Albatross, Domaine du Buis, 207 chemin du Buis 42110 Pouilly les Feurs – France.
6.2 Responsibility of Users
- Strictly personal use of the Gaia Voice Platform and Coach
Use of the Platform and the Gaia Voice Coach is strictly personal and at the discretion of the User and, where applicable, his/her Legal Guardian.
Users’ access to the functionalities of the Platform and Coach Gaia Voice is intended to enable them to use the Services on a strictly personal basis. Access to the Platform and use of the Gaia Voice Coach for other purposes is the User’s own responsibility.
- Compliance with CGU
The User or Beneficiary undertakes to use the Gaia Voice Platform and Coach in accordance with the conditions defined herein and furthermore :
- not to divert the use of the Platform for commercial purposes, advertising, product sales or any other use that would be contrary to the educational purpose of the Platform and the values of ALBATROSS ;
- not to disrupt the proper functioning of the Site and/or Platform;
- to comply with all the rules and recommendations set out in the GCU.
- Warning
The Gaia Voice Coach aims to support Users in their personal reflection and provide general advice on themes related to the work of authors and creators selected by ALBATROSS on the basis of the United Nations’ 17 SDGs. However, the answers generated by the AI are automatic, sometimes based on general data, and do not always and systematically and necessarily take into account the specific personal, emotional or psychological situation of each User.
The Gaia Voice Coach is not a substitute for guidance by experienced adults (including parents, teachers and educators), nor for the advice of qualified professionals such as therapists or doctors. In the event of unhappiness, emotional distress or deep questioning, it is imperative for the User to consult a trusted person or a qualified health professional.
Parents and/or Legal Guardians are invited to accompany Users in the use of the Platform and the Gaia Voice Coach, to supervise their use and to engage in a dialogue on the subjects discussed.
VII. LIABILITY
ALBATROSS, the Site and the authors and creators selected by ALBATROSS decline all responsibility in the event of any negative impact resulting from the use of the Platform and the Gaia Voice Coach by the User. As they are not in a position to assess the psychic and emotional capacities of Users wishing to use the Platform and the Coach Gaia Voice, they cannot under any circumstances be held liable for any direct or indirect damage suffered by a Beneficiary in connection with the use of the Platform, the Services and the Coach Gaia Voice.
Use of the information and/or documents available, stored or shared via the Platform is made under the entire and sole responsibility of the User and/or his/her Legal Guardian, who guarantees that he/she is capable of using the Platform and assumes all consequences that may arise therefrom, without ALBATROSS , the Site or the authors and creators selected by ALBATROSS being able to be held liable in this respect, without recourse against the latter.
In no event shall the latter be liable for any damages whatsoever resulting from the interpretation or use of the information, documents, data and/or advice available or shared via the Platform.
They cannot guarantee that the information and documents submitted or shared via the Platform and the Gaia Voice Coach are error-free, correct and/or suitable for the User.
ALBATROSS shall not be held liable for any damage to the User’s software or equipment and/or for any piracy to which the User may fall victim while using the Platform or browsing the Site and which is not directly attributable to a proven fault on the part of ALBATROSS.
VIII. PLATFORM AVAILABILITY
ALBATROSS and the Site will do their utmost to ensure that Users have access to the Site and the Platform at all times. Nevertheless, Beneficiaries acknowledge and accept that the Platform and the Gaia Voice Coach are provided through the third-party service provider “personal.ai” over which ALBATROSS and the Site have no control.
The operation of the Site and Platform may be temporarily interrupted for any reason beyond the control of ALBATROSS, including in the event of force majeure, maintenance, updates or technical improvements, or to change its content and/or presentation.
ALBATROSS and the Site shall not be liable for failure to operate, inability to access, or poor conditions of use of the Site and/or Platform, nor for temporary or permanent interruption of the Site and/or Platform, or destruction of data, for any reason whatsoever.
ALBATROSS and the Site shall not be held liable for any damage caused by the unavailability of the Site and/or the Platform.
IX. MALFUNCTIONS AND RECOMMENDATIONS
ALBATROSS and Site cannot be held responsible for any technical malfunction on the Platform, but they undertake to deal with such malfunctions as quickly as possible.
All Platform Users undertake to do their utmost to report to ALBATROSS any malfunctions observed on the Site or Platform.

X. FORCE MAJEURE
In the event of force majeure as defined by current case law, the obligations arising from the GCU will be suspended for the duration of the event in question, without prejudice or compensation for either Party.
XI. PROTECTION OF PERSONAL DATA
ALBATROSS is committed to preserving the privacy of Beneficiaries, and makes every effort to protect the security and confidentiality of their personal data. For more information on how this personal data is processed within the framework of the Platform and the Site, Beneficiaries are invited to consult the Platform’s Privacy Policy, which can be accessed by following this link: https://albatrossglobal.org/politique-confidentialite/.
As the Platform is hosted by the AI tool developed by the third-party service provider “personal.ai”, the latter’s privacy policy and other legal terms as applicable at the time of subscribing to the tool with said service provider are applicable to you and we invite you to read them via the following link https://www.personal.ai/privacy-notice. ALBATROSS has no control over the use of your personal data by “personal.ai”, and cannot be held responsible for the consequences of such use.
XII. INTELLECTUAL PROPERTY
Subject to the intellectual property rights of “personal.ai” and the authors and creators selected by ALBATROSS, the structure, content, presentation and elements of the Site, the Platform and the Services, including but not limited to the distinctive signs, logos, functionalities of the Platform, contractual documentation and graphic charter of ALBATROSS are the exclusive property of ALBATROSS, and may not be reproduced, used or represented for purposes other than those provided for herein without the express authorization of ALBATROSS.
ALBATROSS grants Users a temporary license to use the intellectual property rights strictly necessary for their personal and private use of the Platform and the Gaia Voice Coach. Any other use is strictly forbidden without the express written authorization of ALBATROSS.
In particular, Beneficiaries shall refrain from modifying, copying, reproducing, downloading, broadcasting, transmitting, commercially exploiting and/or distributing in any way whatsoever the content, Site pages or computer codes of the elements making up the Site and Platform.
XIII. MISCELLANEOUS PROVISIONS
In the event that any part of the GCU should be found to be illegal, invalid or unenforceable for any reason whatsoever, the term or terms in question shall be declared non-existent and the remaining terms shall retain their full force and scope and continue to be enforceable. The terms declared non-existent will be replaced by terms that most closely resemble the content of the cancelled clause and the original intention of ALBATROSS.
XIV. APPLICABLE LAW AND JURISDICTION
The GCU are governed, interpreted and applied in accordance with French law, the language of interpretation being French.
In the event of a dispute as to the meaning of a term or provision of the GTU, the User may contact ALBATROSS via the address info@albatrossglobal.org or by post: Albatross Foundation, Domaine du Buis, 207 chemin du Buis, 42110 Pouilly les Feurs, France.
In the event of a dispute, the Beneficiary and ALBATROSS will endeavor to find an amicable solution.
Failing amicable agreement, any dispute relating to the conclusion, validity, performance or interpretation of the GCU shall be submitted to the exclusive jurisdiction of the French courts.
XV. MODIFICATIONS TO THE GENERAL CONDITIONS OF USE
ALBATROSS reserves the right to modify all or part of the GCU at any time. Users are informed of the nature of these modifications via the Site and/or the Platform. Any use of or access to the Platform subsequent to a modification of the GCU shall constitute acceptance by the User.
